1. Customer Declaration
- 1.1. You are over the legal age of 18 years.
- 1.2. You are one of the registered owners of the property at the installation address and your name is on the title deed of the installation address.
- 1.3. You have never received or have never been approved for any rebate, Financial assistance, solar credit or small-scale technology certificate (STCs) for small generation solar power system at the installation addresses.
2. Payment & STC’s
- 2.1. ECO SOLAR POWER must have the final payment upon the full completion of the installation by Credit Card or Cheque. If you prefer Electronic Fund Transfer (EFT), the transaction must be completed within 48 Hours of installation completion and you must provide us with written proof of the transfer.
- 2.2. You are agreeing to pay ECO SOLAR POWER the STC’s as part payment for your system. The STC’s will be paid directly to ECO SOLAR POWER or an ECO SOLAR POWER agent. If the Office of Clean Energy Regulator ( http://ret.cleanenergyregulator.gov.au/ ) determines you are not eligible to receive STC’s, and therefore ECO SOLAR POWER is unable to receive the STC’s as part payment, you will be liable to pay ECO SOLAR POWER the value of the STC’s, as determined by market rates.
- 2.3. If you are not eligible for STC’s, or if you wish to claim the STC’s incentive yourself, then complete payment including trading costs of STC’s of the system is due before installation.
- 2.4. You acknowledge that if you breach any conditions of the STC’s incentive regulations, you may be financially liable to the Office of Clean Energy Regulator ( http://ret.cleanenergyregulator.gov.au/ ). If you commit any breach of the incentive regulation, you acknowledge that ECO SOLAR POWER will not be liable to you.
- 2.5. ECO SOLAR POWER or an ECO SOLAR POWER Agent will arrange for the complete documentation and processing of the sale of STC’s. You acknowledge that the price of STC’s is governed by market movements and the REC guidelines. If the market price falls below a certain price, ECO SOLAR POWER may decide to delay the installation until the price rises to a higher level. ECO SOLAR POWER may use absolute discretion and refuse to carry out installation and refund you complete deposit.
- 2.6. If you fail to pay any amount that is due and payable under this agreement, ECO SOLAR POWER will be entitled to charge interest on the unpaid amount at the current Reserve Bank target cash rate, plus 2%. You will also have to pay ECO SOLAR POWER any costs associated with the recovery of such unpaid amounts.
- 2.7. Title and ownership of the solar system will vest in you upon ECO SOLAR POWER receiving complete payment from you for the cost of the solar system, required inclusions and installation.
- 2.8. Failure to pay the complete amount may result in ECO SOLAR POWER taking legal action against you and it will void all warranties.
3. Authority of Access to Property
- 3.1. You authorise ECO SOLAR POWER and its contractors, employees and installers full access to the property listed for install at all reasonable times to carry out all work associated with the installation of your solar system including site inspections, the signing of required paperwork, the delivery and installation of the PV Solar system, and connection to the grid.
- 3.2. Your cooperation is required to enable site inspections/installation to occur at the earliest convenient time which is confirmed with ECO SOLAR POWER and contractors.
4. Liabilities and Risk
- 4.1. The ownership and insurance risk of the PV solar system passes to you upon installation and ECO SOLAR POWER receiving full payment for the solar system. It is your responsibility to ensure that your property insurance adequately covers the cost of your PV solar system.
- 4.2. You acknowledge ECO SOLAR POWER accepts no liability or responsibility for your STC’s incentive as administered by the Office of Clean Energy Regulator ( http://ret.cleanenergyregulator.gov.au/ ).
- 4.3. You acknowledge ECO SOLAR POWER accepts no liability or responsibility for your STC’s Bonus, also known as the “feed in tariff incentive” as administered by the relevant State or Territory government.
- 4.4. ECO SOLAR POWER accepts no responsibility for any damage or loss caused to your property upon installation as a direct result of negligence caused by the installer. All ECO SOLAR POWER installers are subcontractors who are required by ECO SOLAR POWER to have appropriate third-party damage insurance, under relevant state and territory laws. ECO SOLAR POWER will work with you and the installer to rectify any damage caused to your property by the installer’s negligence.
- 4.5. You acknowledge that ECO SOLAR POWER will not be responsible for any damage caused to old and brittle roofing tiles that may be cracked or damaged during installation.
- 4.6. ECO SOLAR POWER accepts no responsibility for any additional costs associated should you need to obtain an upgrade of your existing meter box or the installation of a new gross/net. ECO SOLAR POWER will not be liable for any unexpected costs which may arise in relation to the removal and handling of asbestos at your property in relation to the installation of the solar system.
5. Meter Connection / System Configuration
- Ecosolarpower will make a connection offer on behalf of you to energy supplier before installing the system at the premises. Customer will be informed the outcome of the connection application.
If the application is approved, Ecosolarpower will advise the customer by email or text message and notify them for the installation date.
If the application requires further evaluation by energy supplier then Ecosolarpower will not install the system until energy supplier completes the evaluation process and approves the application completely. Customer will be informed about this by email or text message and requested them to wait until energy supplier gives the next update.
If the application is refused by energy supplier then Ecosolarpower will advise the customer again by email or text message and provide the evidence of energy supplier refusal email and refund the full deposit and cancel the contract agreement.
Ecosolarpower will not charge any cost to customer for making a connection offer to the energy supplier.
- Ecosolarpower will submit the connection application for the system as per the Energex maximum export limit of 5kw on single phase supply and 15kw on three phase supply networks.
If the customer is upgrading the system and installing additional system, then the Ecosolarpower will check the Energex portal to see what size of inverter is approved initially for their existing system and then advise the customer according to the following criterion:
For premises without Solar PV systems, Ecosolarpower will submit the application to Energex with export system upto 5kW on a single-phase network and upto 15kw on a three-phase network.
For premises with existing systems and wants to add additional system these export limits will apply:
If less than 5kW inverter is approved initially on a single-phase supply, Ecosolarpower will lodge an application with export system for upto 5kW inverter and over 5kw will be non-export system.
And if less than 5kW inverter is approved on a three-phase supply, then Ecosolarpower will lodge an application with export system for upto 15kW and over 15kw inverter will non export system.
- If customer decide to obtain the Network connection offer by themselves, then Ecosolarpower will support the customer by providing the relevant steps to complete and submit the application successfully.
- Additional minimum charges may be applicable such as $200 to split the system in more than 2 directions.
- Additional $20 per panel charges may be applicable for installing the panels in landscape direction due to the roof space and shorter screw lines width.
6. Delivery and Installation
- 6.1. Estimated time frame for supplying and installing the system is within 6 weeks’ time of contract signed, installation time frame is depending on subject to approval from local gird connection approval, other authorities’ approval (body corporate, local state govt approval if needed) and property travel distance and transportation.
- 6.2. You are not entitled to cancel your order without our consent or seek a refund, loss, damages or compensation for any delays in the delivery or installation caused by peaks in demand, shipment and shortage of panels and material supplied by overseas manufacturers, change in regulations and in extremes weather conditions.

6.3. Home owner must be present during installation to sign the mandatory declaration assigning the STCs to ECO SOLAR POWER, as per the renewable Energy Act (2000).
Should the installer arrive on the agreed date and the home owner is not present, a rescheduling fee of $200.00 will apply and the installation will be delayed.
- 6.4. In regards to any preference regarding panel/Inverter placement, you are required to inform the installer when they arrive on property. Ecosolarpower does not permit any subsequent changes, modification or reinstallation of the installed system.
7. Privacy Policy

7.1. The Purchaser assigns all rights create STCs to Eco Solar Power and authorizes Eco Solar Power to create, apply and retain STCs and all financial benefits or value attributable to them.
The Purchaser acknowledges and agrees that the installation portion of the Price on the Order Confirmation has been calculated on the basis that STCs will be approved by the Australian Government Clean Energy Regulator.
If for any reason Eco Solar Power determines that the STCs are not, or will not be, available to Eco Solar Power as anticipated by Eco Solar Power when calculating the Price, or if you refuse to sign the STC paperwork (i.e. Solar PV STC Assignment Form), then you agree to pay an additional amount to reflect the value of such benefits that are not, or will not be, available to Eco Solar Power.
- 7.2. ECO SOLAR POWER will provide your information to its contractors, employees and installers only as required to effectively perform their duties.
- 7.3. ECO SOLAR POWER will provide your information on your behalf to the relevant bodies for processing the STC’s incentive for selling the STCs, to the electricity distributor for connecting your PV Solar System to the grid and if required to your electrical retailer.
- 7.4. Unless otherwise agreed with you, ECO SOLAR POWER will not provide your personal information to any third parties other than those mentioned above.
- 7.5. You must sign all necessary documents on the date of installation for the performance of all party’s obligations under this agreement.
- 7.6. ECO SOLAR POWER will not sell your personal information under any circumstances.
8. System Guarantees
- 8.1. Subject to clause 8.2.

8.2. We guarantee:
- Our workmanship, and the workmanship of our contractors, in installing the System; and
- The operation and performance of the System, will be free from fault or defect for a period of 10 years commencing on the date the System is installed (Guarantee Period), and we will repair any such default or defect notified to us within the Guarantee Period, including by replacing all or part of the System where necessary, within a reasonable timeframe at no cost to you.

8.3. The guarantee in clause 8.1 will not apply where:
- The fault or defect is not notified to us within the Guarantee Period; or
- The fault or defect is a result of:
- Something done by you or someone else, and not us or our contractors;
- Something beyond human control that occurred after installation;
- The System being misused, abused, neglected or damaged after installation;
- The System being maintained other than in accordance with the Maintenance Documents; or
- The System being repaired, modified, reinstalled or repositioned by anyone other than a service technician approved by us in writing.

8.4. During the Guarantee Period, we will provide reasonable assistance to you in making any guarantee or warranty claim against the manufacturer of the System, including by acting as your liaison with the manufacturer.
During the Guarantee period, Ecosolarpower will cover the labour costs and travel costs in event of system fault and in warranty claim process.
9. Cooling off Period
- 9.1. It’s the customer’s right to cancel this agreement within 10 business days of the date that they sign or receive this agreement under Australian Consumer Law and relevant State Building Act.

9.2. A customer may terminate this agreement by giving a written notice of termination to Eco Solar Power.
A consumer may cancel the agreement without penalty within 10 business days of going into effect, after cooling off period $150 administrative charge will apply.

9.3. The customer will receive a prompt refund of all payments if this agreement ends for any of the reasons listed below, before our system is installed at the premises:
- No later than 10 days after acceptance of this agreement.
- If we have not delivered and installed the System within 6 weeks of contract signing and you wish to terminate the agreement.
- Approval of the Grid Connection is refused.
- If any of the equipment quoted is unattainable and you are not willing to accept equipment of a similar quality.
- In the event that extra charges arise, which were not stipulated in the original contract, and the additional costs are not borne by the Supplier and the consumer does not consent to these additional charges, the consumer will receive a full refund upon request.

9.4. Eco Solar Power may terminate any agreement to supply a system should the government incentives or other benefit, including STCs, is reduced, discontinued, withdrawn or cancelled prior to the installation of your System.
If Eco Solar Power does terminate the sale for this reason, you will be entitled to a full refund.
10. Finance
Financing is not available on advertised specials. Terms and Condition of repayment of finance and interest will be provided by the Finance Company.
11. Feed in Tariff
Consumer need to contact their electricity retailer or relevant State or Territory government before sign this contract in regards to feed in tariff, their electricity contract/tariff may change, following installation of solar and that the consumer should contact their electricity retailer: the “feed in tariff incentive” as administered by the relevant State or Territory government.
Consumer needs to check before signing a contract, to check what new electricity tariff rates may be applied; and after installation of the solar PV system, to confirm that the agreed tariff has been applied.
12. Loss of Feed in Tariff
This clause applies to a customer who has a pre-existing solar system. The upgrade of your pre-existing solar system/panel add-on/complete replacement may significantly reduce the current Feed-in-Tariff being received from the retailer for generation by your pre-existing solar system.
You should discuss this loss with your retailer to ascertain the new Feed-in-Tariff. The reduced rates may impact on your return on investment/Expected Payback period.
In no circumstance will Ecosolarpower be liable for any loss of your feed in tariff as a result of Ecosolarpower carrying out an upgrade/panel add-on/complete replacement of your pre-existing solar system.
13. Other Terms
- Any requirement to provide a document or information in writing can be met in electronic form, or to provide a signature can be met in electronic or verbal form.
- In addition to this agreement, various laws and codes, including the Australian Consumer Law and, if we have volunteered to be bound by it, New Energy Tech Consumer Code (NETCC), also contain rules applicable to the sale and installation of solar photovoltaic systems, and we will comply with these rules in selling you the System and installing it at the Premises.
